About these terms
Last updated: October 19, 2026
Three Side Design LLC, a Pennsylvania limited liability company, runs Upfront Accessible. In these terms, “we,” “us,” and “our” mean Three Side Design LLC doing business as Upfront Accessible. “You” means anyone who uses upfrontaccessible.com or our services.
These terms cover two groups of people:
- Visitors who read the accessibility profiles on this site.
- Businesses that have an accessibility profile, including members.
By using this site or our services, you agree to these terms. If you don’t agree, please don’t use the site. If you need these terms in another format, or have a question about them, email info@upfrontaccessible.com.
What Upfront Accessible is, and what it is not
Upfront Accessible publishes accessibility profiles: photographs taken at seated eye level, from the curb to the counter, with measurements written out. The business reviews its profile and signs an attestation that it is accurate.
The business provides the accessibility information on its profile. We photograph and publish what the business documents. We do not inspect, rate, or certify.
That means:
- A profile is not a finding that a business complies with the Americans with Disabilities Act or any other law, code, or standard. It is also not a finding that a business does not comply.
- We do not give a score, a grade, or a pass or fail.
- We are not lawyers, building inspectors, or accessibility auditors. Nothing on this site is legal advice.
- A business having a profile, or being a member, does not mean we endorse it.
- A business not having a profile says nothing, good or bad, about its accessibility.
If you use a profile to plan a visit
Think of a profile as a starting point for your own decision. Please keep these limits in mind.
- Each profile describes the business on the dates shown on it. Doors, furniture, mats, signs, and staff practices can change after that.
- Some things on the path move during the day, like planters, sidewalk signs, and wet-floor signs. A profile notes these when we see them.
- We take measurements by hand at one point in time. They are close, not exact.
- We publish measurements, not a verdict. Compare them against your own wheelchair, scooter, walker, or needs, and decide for yourself.
- Each profile shows the dates of its photos, the date the business last attested to it, and when the next attestation is due.
- If something matters to your visit, contact the business before you go.
You use the information on this site at your own risk. To the extent the law allows, we are not responsible for injury, loss, or a wasted trip that results from relying on a profile.
If your business has a profile
Your attestation
Before we publish a profile, an owner or manager reviews it and signs an attestation. By signing, you confirm that:
- You have authority to speak for the business about its premises.
- The details on the profile describe the business as it stands on the date you sign.
- We may photograph the public path into and through your business, and publish those photos with the details you attest to.
The business is responsible for the accuracy of what it attests to.
Keeping it current
If something on the path changes, such as a new door, a moved counter, or a restroom that opens or closes to the public, please tell us within 30 days. We will update the profile, photograph the change if needed, and ask you to confirm it.
The business re-attests its profile once a year. If a year passes without one, we may mark the profile as past its attestation date or take it down.
What gets published
We decide how to write and lay out profiles. Each profile shows everything the business attests to, including barriers. We will not leave out an accurate detail because it is unflattering, change a measurement, or describe a barrier as something it is not.
We may decline to publish a profile, or remove one, if the details don’t match what the photographs show or if we have reason to believe they are not accurate.
Withdrawing your profile
A profile is the business’s own statement, so the business can withdraw it. Email info@upfrontaccessible.com and we will take the profile down within 10 business days. The “Payment, cancellation, and refunds” section below covers fees.
Photos and who owns them
- We own the photographs we take and the profile pages we write.
- If a business sends us its own photos or documents, the business keeps ownership. It gives us a non-exclusive, royalty-free permission to use, crop, resize, and publish them for as long as the profile stays live.
- While a profile is live, the business may link to it and share it anywhere, including its website, Google Business Profile, social media, and email signatures.
- While a profile is live, the business may also use our photos of its own premises on its website and social media, with credit to Upfront Accessible.
People in photos
We photograph the path, not the people on it. If someone in a photo is recognizable, we blur them before we publish it. If you see yourself in a photo and want it changed, email us and we will blur or replace it.
How we edit photos
We do not edit photos in ways that change what the path looks like. We may crop, resize, and blur people for privacy. Each profile says what, if anything, we changed.
Corrections and notes
Anyone can report something on a profile that looks wrong or out of date. Email info@upfrontaccessible.com with the business name and what you noticed. We will check with the business and update the profile if the business confirms the change.
We may add a clearly labeled, dated note to a profile for something observed during a visit or reported to us that was not part of the signed attestation. The note will say where the information came from.
Memberships, badges, and decals
Businesses can join Upfront Accessible as members. The sign-up page or your written quote shows what a membership includes, its price, and its billing period. A founding member rate stays the same for as long as the membership stays active without a gap.
Membership does not change what a profile says. We document members and non-members the same way, to the same standard.
Using the badge and decal
The Upfront Accessible badge and window decal say one thing: this business has published its accessibility information. While your profile is live, and your membership is active if the badge came with a membership, you may display them. When you do:
- Link the badge to your profile.
- Use them as we provide them, without changing the colors, wording, or proportions.
- Do not use them to say or suggest that your business is certified, inspected, approved, or ADA compliant.
- Remove the badge from your website and the decal from your window within 30 days after you withdraw your profile or your membership ends.
Payment, cancellation, and refunds
- You’ll find prices on our site or in a written quote. Stripe processes payments. We do not see or store your full card number.
- We bill monthly memberships in advance. They renew each month until you cancel.
- You can cancel at any time by emailing info@upfrontaccessible.com. Cancellation takes effect at the end of the period you have already paid for. We don’t refund partial months.
- Fees for one-time work pay for work that starts right away, so they are not refundable once work has begun. If we can’t deliver work you paid for, we will refund what you paid for it.
- If a payment fails and you don’t fix it within 14 days, we may pause membership benefits, including use of the badge.
- Prices may change. We will email current monthly customers at least 30 days before a price change takes effect. See above for founding member rates.
Separate written agreements
We do some work, such as a district or partner pilot, under a separate written agreement. Where that agreement differs from these terms, the agreement controls.
Accounts
Some businesses have a login to manage their profile or membership. Keep your login private, and tell us right away if you think someone else has used it. You are responsible for what happens under your account. Accounts are for businesses and adults. Children under 13 should not use this site.
Things you may not do
- Copy, scrape, or republish profiles, photos, or measurements in bulk, or use them to build another directory, dataset, or AI model, without our written permission. Linking to a profile and quoting it with credit is welcome.
- Give us false information, or sign an attestation for a business you don’t have authority to speak for.
- Try to break, overload, or get around the security of the site.
- Use the site to harass anyone, including business owners and people who report corrections.
What you send us
If you send us a correction, comment, photo, or suggestion, you confirm it is yours to share and accurate as far as you know. You give us permission to use it to update profiles and improve our service. We won’t publish your name with it unless you agree.
Your information
We collect only what we need to run the site and our services: the name, email address, and business details you send us, account details if you have a login, and basic technical data such as IP addresses in our server logs. That information lets us answer you, provide our services, and keep profiles current. We do not sell your personal information. Stripe handles payments under its own privacy policy.
Our name and content
Upfront Accessible™, our logo, the badge, the Upfront Accessible Documentation Standard, and the text and photos on this site belong to us, or to the businesses that provided them. These terms don’t give you any right to use them except as described here.
Links to other sites
Profiles and pages may link to other websites, such as a business’s own site or a parking authority. We don’t control those sites and are not responsible for them.
Disclaimers
To the fullest extent the law allows, we provide this site, the profiles, and our services “as is” and “as available.” We make no warranties, express or implied, including warranties of accuracy, merchantability, fitness for a particular purpose, and non-infringement. We don’t promise the site will always be available or free of errors.
Limit on our liability
To the fullest extent the law allows:
- We are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, arising from this site, the profiles, or our services.
- Our total liability for any claim will not exceed the greater of what you paid us in the 12 months before the claim, or $100.
Some places don’t allow these limits, so they may not apply to you.
Claims against us caused by you
If someone makes a claim against us because of information or content you gave us, your use of the badge or decal, or your breaking these terms, you agree to cover our reasonable costs of defending it, including attorney’s fees, and any amount we have to pay.
Ending access
We may suspend or end your access, or remove content, if you break these terms or if the law requires it. The parts of these terms about ownership, disclaimers, our liability, claims, and governing law continue to apply after that.
Pennsylvania law
Pennsylvania law governs these terms. The state or federal courts in Allegheny County, Pennsylvania, will hear any dispute.
Before taking any formal step, please email us. We can fix most problems with a conversation, and we will try to resolve yours within 30 days.
Changes to these terms
We may update these terms. The date at the top shows the current version. If a change materially affects members or clients, we will email you at least 30 days before it takes effect. Using the site or our services after a change takes effect means you accept it.
The rest of the fine print
- These terms, plus any separate written agreement you have with us, are the whole agreement between us.
- If a court won’t enforce any part of these terms, the rest still applies.
- If we don’t enforce a part of these terms right away, we can still enforce it later.
- You may not transfer your rights under these terms without our written permission.
